在前几期中为大家介绍了电力行业的许可证、电力行业如何融资等信息（详见《印尼投资系列 | 印度尼西亚电力行业的许可证制度》、《印尼投资系列 | 电力行业融资方案》），今天我们来讲讲 PLN 采购电力的相关程序。
01
电力购买方式
Purchase of Electricity
根据《2012年第 14 号政府条例：电力供应业务》（经《2014年第 23 号政府条例》修订）第 25 条第（2）款规定，
印尼国有电力有限公司需通过公开招标的形式购买电力供应营业许可证持有人的电力。
在特殊情况下，可以通过直选或直接任命的方式来购买电力。印尼国有电力有限公司需依据电力供应营业计划公开购买。
Pursuant to Article 25(2) of the Government Regulation No. 14 Year 2012 concerning Electricity Provision Business as amended through the Government Regulation No. 23 Year 2014, the purchase of electricity by PT. PLN from any IUPTL holder should be conducted through open tender. In exceptional conditions, however, electricity purchase can be conducted through direct selection or direct appointment. PT. PLN shall announce such purchase in accordance with the Electricity Provision Business Plan.

直接任命
Direct Appointment
可以采用直接任命的形式进行购买的情形如下（2015年第 03 号能源和矿产资源部长条例）：
The procurement criteria through direct appointment (Ministry of Energy and Mineral Resources No. 03 Year 2015) are as follows:

火力发电站和坑口发电站电力、天然气发电站和水力发电站（新能源）的边际电力购买；
Electricity purchase from steam power plant, mine mouth power plant, marginal electricity from gas power plant, and hydroelectric power plant (renewables);
坑口发电站、燃煤发电站、天然气/燃气机发电站和水力发电站的多余电力购买；
Purchase of excess supply from mine mouth power plant, coal-fired steam power plant, gas/gas-machine power plant, and hydroelectric power plant;
在当地电力系统发生危机或紧急情况时，从坑口发电站、燃煤发电站、天然气/燃气机发电站和水力发电站购买电力；
Electricity purchase from mine mouth power plant, coal-fired steam power plant, gas/gas-machine power plant, and hydroelectric power plant, under the circumstances of a crisis or emergency occurring in the local electricity system;
为了增强在类似的地方运营的发电站的发电功率，从坑口发电站、燃煤发电站、天然气/燃气机发电站和水力发电站购买电力；
Electricity purchase from mine mouth power plant, coal-fired steam power plant, gas/gas-machine power plant, and hydroelectric power plant, in order to increase the electricity generation capacity of the power plant operating in similar location.

直选
Direct Selection
如果直接任命申请人数超过1人，将通过直选的方式进行采购。
Where there are more than 1 the direct appointment applicants, the procurement mechanism will shift to direct selection.
可以采用直选的形式进行购买的情形如下（《2015年第 03 号能源和矿产资源部长条例》）：
The criteria of procurement conducted through direct selection (Ministry of Energy and Mineral Resources No. 03 Year 2015) are as follows:

推动能源多样化进程，建立更多的非燃料发电站；和/或
由电力供应营业许可证持有人或感兴趣的开发商建立的新企业实体在本地系统内的不同地区运行的发电厂的附加发电功率。
Additional generation capacity of power plant which has operated at different locations within the local system by either IUPTL holder or new business entity established by interested developer.
在以下情形中，允许采用直选：
Direct selection is allowed under the following circumstances:
1超过1（一）名开发商/申请人参与直接任命的；或
The number of developer/applicant for direct appointment is more than 1 (one); or2申请人提供的功率超过附加功率需求。
The capacity offered by the applicants exceeds the additional capacity needs.

公开招标
Open Tender
通过公开招标的方式进行购买电力应符合电力供应营业计划的要求（《2006年第 01 号能源和矿产资源部长条例》和《2007年第04号能源和矿产资源部长条例》）。
Procurement conducted through open tender (Ministry of Energy and Mineral Resources No. 01 Year 2006 and Ministry of Energy and Mineral Resources No. 04 Year 2007) should be in line with the Electricity Provision Business Plan (RUPTL).
招标候选人在参加投标前应通过投标委员会的资格预审和评估。
The tender participant candidates shall pass the pre-qualification and evaluation phases conducted by the tender committee before participating in the tender.
资格预审文件至少应包含以下内容：
The pre-qualification document consists at least of the following:
模板，其中包括说明行政信息、技术和财务能力的填表，以及拒绝存在任何利益冲突的声明。
Sample forms, among others those related to administrative information, technical and financial capabilities, and a statement letter denying any existence of conflict of interests.
电力购买或网络租赁计划范围;The scope of electricity purchase or network leasing plan;资格预审计划表；
Pre-qualification schedule;
对投标者的要求；
Participant requirements;
文件评估程序；
Documentary assessment procedure;
在评估阶段，至少应该选中 3（三）名申请人参与招标。若无法达到这个标准，将重新进行资格预审。
如果只有 2（两）名申请人参与第二次资格预审，则这 2（两）名申请人可以直接进入招标阶段。
如果只有 1（一）名申请人达到了资格预审标准，那么将改为直接任命的形式（进行电力购买）。
During the evaluation phase, at least 3 (three) applicants will be appointed to participate in the tender. Where such target is unattainable, a repeated pre-qualification will be held. If the repeated re-qualification only yield to 2 (two) participants, they will immediately become the tender participants. If only 1 (one) participant passes the pre-qualification standard, the process will thereafter resort to a direct appointment.
从资格预审、购买价格协商到达成协议的整个电力购买过程将花费大约 150（一百五十）个工作日。
The entire process from pre-qualification, purchase price negotiation, up to the conclusion of the agreement shall take approximately 150 (one hundred and fifty) working days.
感兴趣的企业实体若要参与电力购买，应该满足以下条件：
The following requirements shall be fulfilled by interested business entities to participate in electricity procurement:
Fulfilling the technical requirements referring to the benchmark of:
✎电力部门的印尼国家标准（SNI）；
The Indonesian National Standard (SNI) in the electricity sector;
✎国际标准；或
The International Standard; or
✎其他至今不与国际标准化组织（ISO）或国际电工委员会的标准相悖的标准。
Other standards insofar as not contradictory to the International Organization for Standardization (ISO) or the International Electro technical Commission (IEC).
Taking into account the highest benchmark price (without obtaining any prior approval from the Ministry)；
✎采购价格可按照购电协议的规定进行调整。
The procurement price is subject to adjustment as set out in the PPA.
✎在某些地区允许使用最高基准价格，如部长的预先批准的印尼国有电力有限公司预计价格。
A price set above the highest benchmark price is allowable in certain locations i.e., based on the price estimation by PT. PLN and upon prior approval from the Ministry.
不管现行法律发生何等变化，从事电力行业的每个企业实体都应该遵守法律要求并遵循电力供应的程序，特别是部门条例中强调的与安全问题有关的规定。
Despite of any further changes occurring in the prevailing laws, each business entities in the electricity sector are encouraged to fulfill the entire legal requirements and following the stipulated procedure of participating in the electricity provision, most importantly those related to safety issues as have been particularly emphasized by the sector’s regulator.
